General Notes: [Master File.ftw]

From Drake in England, p. 64, 65:
At the Court held on 14 June 1302, he gave 4s. for his entry fine"upon one cotland which his father held," his pledge being G. Symund. The entry fine usually represented the rentable value of the holdingfor a year. At the same Court his wife, who is not named, was finedthe customary 6d. for brewing. Nicholas must have been a good farmerand have prospered, for three years later we find him paying another2s. for entry on three rods of land lying at "Eldo land by Graunger'sland" and agreeing to pay a half-penny annually at Michaelmas forincrement. Again G. Symund was one of his pledges, the other beingWalter Wrungy. Then, at the Court held on 29 October 1317 he is namedas one of the sureties for William atte Bregge, who "received thelord's great mill and the farm from Michaelmas last past for two yearsthence ensuing ... paying to the lord annually during the said twoyears 32, quarters of corn and i2 quarters of [word illegible]." Themill was not only important to the lord for such returns but alsorepresented the most costly building, other than his house or theparish church, which he would need to provide for his manor. The needto find sureties for its safety as well as the income, whether inmoney or in kind as here, is obvious and the sureties would be drawnfrom among the more substantial tenants.
In Drake in England the question of who was Nicholas's father was leftopen, although the present solution was advanced. During the restudyof the evidence the following considerations were thought to make thefact that he was the son of the first Nicholas Drake reasonablycertain, a view which was accepted by the College of Arms examiners. The given facts are that he was of age, married, and his father deadbefore 14 June 13o2,. At the Courts in 1303 the widow of NicholasDrake is named and G. Symund acts as her pledge, as he does for thesecond Nicholas. Now she cannot have been the widow of the latter, forno report of his death or of the admission of an heir was found in theintervening Courts, and the conclusion that she was his motherfollowed. The link being strengthened by G. Symund, who must have beena close friend of the family, agreeing to act as their pledge.
It is unfortunate that the Court Rolls for 1305-16, 1320-25 and 1330have not survived so that the full details of his transactions couldbe traced, for it would appear that he was the founder of the family'sfortunes in the ways open to the manorial tenant of his day. He isnamed in the taxation roll Of 1327 when 124 of the inhabitants ofGreat Waltham were assessed to pay the twentieth part of the value oftheir moveable goods, certain items being excepted, paying 13 3/4d. sothat his goods were then worth rather more than 1.2.11 pounds...
In the next year, or at any rate shortly afterwards, a Survey orExtent of the Manor was made. The original has not survived but aslightly later copy, incomplete at the beginning, was written on theback of a parchment roll made from various scraps shortly after 1354.This has never been edited and some of the problems posed by it stillremain to be answered;...The entry for Nicholas Drake is found amongthose for the Molmen, that is customary tenants who had commuted alltheir labor services for payments in money, and reads: "Nicholas Drakeholds 1 1/2 acres of land of granger land, 2 acres of Blachche landand 7 acres of Symon Geffray's land. And renders by the year 2s. 6d.,that is to say equally at the four terms."
Formerly he had held some land for which only part of the laborservices had been commuted but this was now owned by Maud "Cissor"(the Taylor). Among the entries for the Molmen is one for JulianaDrake, the only other occurrence of the name in the Survey, who held asmall piece of land (a blot obscures the details) for which ahalfpenny was paid each Michaelmas. Her name was not found in theCourt Rolls and the most probable explanation is that she was theunnamed wife of Nicholas Drake presented for brewing in 1302.

That Nicholas' wife was named "Juliana" is plausible, but not proven. From "Drake in England," p. 65: "Among the entries for Molmen [tenantswho had commuted all their labor services for payments in money] isone for Juliana Drake, the only other occurrence of the name in theSurvey, who held a small piece of land (a blot obscures thedetails)for which ahalfpenny was paid each Michaelmas. Following is a brief summary of Henry's entry from the "Dictionary ofNational Biography" :

He served with EDWARD I in Flanders in 1297 and 1298. He fought inScotland several times between 1298 and 1305. In 1315 he, in commonwith the other lords of the Welsh marches, joined the Earl of Herefordin putting down the rebellion of Llewelyn Bren, and in 1318 he wasordered to bring his Welsh retainers to Newcastle to serve against theScots. He was opposed to the Despensers, for the greediness of theyounger threatened the lords marchers generally; but he does not seemto have had any violent feelings against the king, and was notinvolved in his brother's [Thomas, Earl of Lancaster] treason. In 1324he was created Earl of Lancaster, Earl of Leicester, and Steward ofEngland, dignities which had been held by his brother. It is evidentthat he was indignant at his brother's fate, and was resolved toavenge it, and was not appeased by these honors. In 1324 the Kingunsuccessfully had him tried for treason. He was, at this time, regarded as the foremost man in the kingdom. Henry supported QueenIsabel upon her return to England and he was instrumental in thedownfall of the Despensers and had custody of King Edward II for atime during his imprisonment. He is said to have treated the King veryhumanely. Henry was the guardian of King Edward III during hisminority and was the chief member of the council of government. In1326 he took the lead in opposition to the rule of Queen Isabel andher paramour, ROGER MORTIMER, EARL OF MARCH (RIN 684). Early in theyear 1330, following a slow degeneration of his vision, Henry becametotally blind. Still, he persuaded the king of the necessity ofgetting rid of MORTIMER and was the mastermind of the plot which ledto MORTIMER'S capture, trial, and execution late in the year. TheEarl's blindness, which he bore with patience, forced him to retirefrom active life; he gave himself wholly to devotion. He was courteousand kindhearted, of sound judgement, religious, and apparently of high

He served with the King in Flanders 1297-98; andthereafter served in Scotland nearly every year up to 1323, being from1310 onwards frequently ordered to send men from his Welsh lordship toserve in the Scottish wars. He was summoned to Parliament v.p., from 6February 1298/9, by writs directed Henrico de Lancastre nepoti Regisand Henrico de Lancastre, whereby, according to modern doctrine, he isheld to have become LORD LANCASTER. He attcstcd a charter at St.Albans 3 November 1299. He took part in the siege of Carlaverock inJuly 1300. As Henry of Lancaster, Lord of Monmouth, his seal isappended to the Barons' Letter to the Pope, 12 February 1300/1. On 22January 1307/8 he was commanded to meet Edward II and his Queen atDover, after their marriage at Boulogne. At the Coronation, 25 Feb.1307/8, he bore the Rod with the Dove. In August 1309 he joined in theBarons' letter to the Pope about abuses. On 17 March 1309/10 he wasone of those who forced the King to agree to the appointment of theLords Ordainers. He was pardoned, among other adherents of EarlThomas, 16 October 1313 for participation in the execution ofGavaston. As one of the Lords Marchers he was involved in the fightingin South Wales, January 1315 to March 1316, occasioned by therebellion of Llywelyn Bren. In June 1317 the King wrote to Philippe ofFrance asking him to respite the homage of Henry of Lancaster for hislands in Champagne and Brie as he was needed in England. In 1370 hejoined the confederacy of the Marchers against the Despensers, andcivil war raged for some time in South Wales, the native Welsh sidingwith the Marchers; however, he took no part in the rebellion of hisbrother Thomas in 1322. In 1323 he petitioned the King and Council forthe earldoms of Lancaster and Leicester, and received a writ of liveryof the earldom and honour of Leicester 29 March 1324 (the castle ofKenilworth excepted), becoming thereby EARL OF LEICESTER, and possiblySteward of England. He was summoned, 13 September 1324, to the GreatCouncil at Salisbury as Earl of Leicester, and as Henry de Lancastria,"now Earl of Leicester," he received the honour of Leicester 8November 1324. In May 1325 he was accused of treason because he hadwritten a letter of consolation to the Bishop of Hereford (Adam ofOrlton), used his brother's arms, and set up a cross near Leicester toinduce passers-by to pray for his brother; but no proceedings weretaken against him. In August of that year he was in readiness toattend the King with a suite of 8 followers when Edward made apretence of setting out for France to do homage for Aquitaine andPonthieu---a journey which was never taken. On the Queen's return toEngland with Roger de Mortimer in September 1326, Henry joined herparty against Edward II, which led to a general desertion of theKing's cause, and was appointed Keeper of the castles of Abergavennyand Kenilworth. He was present as EARL OF LANCASTER AND LEICESTER, 26October 1326, at Bristol, at the extraordinary Council which electedPrince Edward, then Duke of Aquitaine, keeper of the realm during hisfather's absence, the King having fled to Wales. Henry was sent inpursuit and captured the King at Neath, taking him thence toLlantrisant, co. Glamorgan, 16 November 1326. He was appointed to takecharge of the King, and was responsible for his custody at Kenilworthtill 4 April 1327. As Henry, Earl of Lancaster, he was appointed, 7December 1326, Keeper of the castle and honour of Lancaster, thecastles and honours of Tutbury and Pickering, the Manor of Melbourne,co. Derby, and the manor of Stanford, co. Bucks. and as Henry, Earl ofLancaster and Leicester, Keeper of various manors in cos. Lincoln,Derby, Yorks, Bucks, Rutland and Leicester. He was present, 1 February1326/7, at the Coronation of Edward III whom he knighted, and of whomhe was appointed guardian. On 3 February his brother Thomas wasrehabilitated in Parliament, whereby Henry's right of succession tohis brother in the Earldom of Lancaster was recognised. He was also inthis year, 1327, appointed Captain General of the King's armiesagainst the Scots. The Queen and Roger de Mortimer, however, usurpedthe authority with which Henry had been invested by the generalconsent of the magnates for the better government of the King and ofthe realm, and Henry was unable to control or to advise his youngcharge. On 23 April 1327 he had livery of a large number of honoursand manors late of Thomas his brother, the King having taken hishomage. On 17 February 1327/8 the Exchequer was ordered to search therolls of the accounts of the sheriffs of co. Lancaster and to allowHenry to receive ferms and issues of the county as had Edmund hisfather and Thomas his brother. He with Lord Wake and others refused toattend the Parliament summoned to meet at Salisbury on 16 October1328, where Mortimer had assembled a large armed force. Mortimer setthe Royal forces in action against them, and the Earl's town ofLeicester was ravaged. He marched at the head of his own men. and someLondoners, but his chief supporters fell away and he was obliged tomake his submission at Bedford. Orders were issued for the seizure ofhis lands in January 1328/9, but rescinded in February upon a heavyfine, which was forgiven in December 1330. On 12 September 1329 he hada protection on going beyond seas, and in that month set out forFrance with a large retinue. On 3 December he was joined with theBishop of Norwich in the negotiations with King Philippe touchingquestions still at issue between the two Kings after Edward's act ofhomage at Amiens on 6 June. On 27 January 1330 the Ambassadors hadfurther instructions to negotiate marriages between Jean, eldest sonof King Philippe, and Edward's sister Eleanor, and John of Eltham andPrincess Marie of France, in which they did not succeed. At about histime he became blind. On 2 April 1330 he had licence to found ahospital for poor persons and pilgrims in his town of Leicester, to be
served by 4 or 5 chaplains, and to appropriate to it Ircester church,of his patronage. On the fall of Mortimer in October his closepersonal relations with the young King were renewed. On 1 February1331/2 he had remission of £221 13s. 4d. relief on succeeding to hisbrother Thomas's lands, because the King had had them in his own handfor six years after the death of Thomas. On 27 Mar. 1332, for thespecial affection which he bore him, the King granted Henry 500 marksyearly for the better maintenance of his estate. In December 1334Henry made a gift to the nuns of Canons Ashby. In 1335 he was with theKing at Newcastle-on-Tyne, where the invasion of Scotland by EdwardIII and Balliol, from Carlisle and Newcastle respectively, was plannedand carried out.
