General Notes: [Master File.ftw]

The Murder of King Edward the 2nd. by Sir Thomas Gourney at BerkeleyCastle, Gloucester. England.
Sir Thomas Trivett bc.1290 d.1316 m Joan ? His widow Joan Trivett thenmarried Sir Thomas Gourney/Gurney that same year.
Edward 2nd B1284 -King 1307 - 1327 was disliked by the majority ofBarons and Lords and certainly was not favourite of the people of thecountry whom he cared little for. This was caused by his constantactions of enjoying himself to extremes i.e. indulgent eating anddrinking. His obvious liking of men as to women, with his favouritesbeing Gaveston and Spencer. After the death of his father Edward 1st,he was made King and married Isabella daughter of Philip King ofFrance ( supposedly the most beautiful woman in France) she bore oneson, the future Edward 3rd. It soon became apparent to her that herhusband Edward the 2nd preferred the company of his male favourites asto her, he also physically abused her quite often. Isabella becameclosely acquainted with Roger Lord Mortimer of Wigmore and Chirk. Hehad also gained Ludlow and half Meath by marriage, and made himselfEarl of the Marches, and justiciar of Wales for life, which was to endon the gallows at Tyburn (now Marble Arch) in 1330.
Isabella soon had an ongoing affair with Lord Mortimer and found anexcuse, much to the dislike of the king, to go back to France with herson and secretly with Mortimer. They gathered an army together payingfor it with a betrothal between Edward and Philippa of Hainault. Theycrossed to England in September 1326, by November they had the kingprisoner.
In 1327 Sir Thomas Lord Berkeley owner of Berkeley Castle was joinedwith Sir John Maltravers with the commission of guarding the captivemonarch Edward the 2nd. Lord Berkeley was called away in Sept of thatyear and Sir Thomas Gourney together with William Ogle was put incharge of the situation of watching over the King.
One night the inmates of the castle were alarmed by the shrieks whichcame from the kings apartment. The king was found dead. His death hadbeen brought about by the insertion of a red hot iron into his bowels. One wonders whether this may have been a disgust of his lifetimeactivity. Sir Thomas Gourney and William Ogle were accused of hismurder but they made their escape. I don't know if Ogle was everfound, Sir Thomas was detained in Spain and was brought back toEngland, but I can find no record of his punishment, if there was any.Maltravers was falsely accused of this crime but he was executed for asimilar offence elsewhere.
(New piece of information given by a Russell Gurney---There is a bookpublished privately in c1848 (author Daniel Gurney) that implies thatThomas de Gournay was taken ill during his return to England (underguard). According to this book-The Record of the House of Gournay- hedied before he reached England, probably in France.)
It is obvious that the murder or execution? of Edward the 2nd by SirThomas Gourney and William Ogle was orchestrated by a much higherauthority than them such as Mortimer and Isabella the Queen. After thekings death there was little remorse, especially from the people ofthe country.

From "Drake in England" p. 65-67:
At the Court held on 25 April 1331 "robert son and heir of NicholasDrake" paid his entry fine for the "land of mollond [...of which] hisfather died seised." the entry is not only so badly faded as to bepartly illegible, even with the aid of an ultra-violet lamp, but theparchment is torn so that some of the text is wholly lost. The finalstate of his father's lands is thereby lost and we do not know exactlywhat he had inherited. Like his father he also added to his originalholding, and his wife Elen appears to have held some land in her ownright, for on 12 June 1337 we find one John Geffray surrendering tothe lord "one croft of land which he had acquired of Elen Drake."
On 6 March 1340 we find him defending a suit brought by AgnesWelynough concerning Cockescroft which he had purchased from her inthe Court of 2,i April 1337 and for which 8d. annual rent was due toher. Two years later, on 5 October 1342, Giles the Fullere granted thereversion of "one acre of land lying in Estwode then occupied byJulian Androw." Some land in the same place had earlier been grantedto his father and was the subject of a plea levied by William Symundon 17 December 1360 to which the jurors replied on 10 May 1361 that"Robert Drake holds three acres of land in a certain field calledGreat Estwode ... and that the said William may recover two acres ofland of the said five acres" (which Robert had claimed were his). Sothat both claimants were guilty of wrongful claims and were fined.
A sure sign of the steadily rising status of the family, and a moreimportant one even than his father becoming one of the Molmen sometime before the Survey of the manor described above, is revealed bythe proceedings in the Court on 12, May 1357. "Robert Drake a bondmanof the lord comes and exhibits a certain charter by which he acquiredvarious tenements, (namely 1 acre of rue pasture, a certain lanecalled Parkers lane and 1 acre of land and pasture-interlined), inLittle Leghs." His right to it was disputed by John and Thomas Lucasand the land was taken into the lord's hands. "And upon this comes thesaid Robert and shows his charters and muniments by which hedemonstrates that the said John and Thomas have no right in the saidlands and tenements. Therefore the said Robert is admitted at a newrent, paying 6d. rent at the Feast of Michaelmas annually." This entryis especially interesting as illustrating the way in which the olddistinctions between bond and free tenants were gradually beingeroded. We have already seen how in the former century some of thevilleins commuted their labor services, or the most onerous of them, for a money payment. This at once undermined one of the criteria usedby the lawyers, the lack of control over his daily activities, todistinguish the unfree from the free tenant. The unfree tenant couldnot plead in the King's Courts, except when indicted for major felony, and his land could not legally be alienated by charter. Here, however,we find Robert Drake, still technically his lord's bondsman, holdingsome of his lands by charter, not by surrender and seisin given in theManor Court. Robert Drake appears in the lists of those payingpannage, small sums for the right to turn a specified number of pigsor piglets to forage in the woods, from 1385 to 1392, the year of hisdeath.

Robert* married Ellen 2 before 1337.2 Ellen was born before 1325 in Great Waltham, Essex, England2 and died after 1376 in Great Waltham, Essex, England.2

Ellen's approximate birth, death, and marriage dates can only beinferred from when she is mentioned in Court proceedings. She is firstmentioned, and is married at the time, on June 12, 1337, from which itreasonably can be concluded that she was born prior to 1325 andmarried prior to 1337. Her last mention is in 1376, which means thatshe died in or later than that year. This information is drawn from"Drake in England" p. 66, 67
